Welcome to Dayly. These Terms of Service ("Terms") govern your use of the Dayly iPhone app and the website at dayly.codemxm.com (collectively, the "Service"). By downloading, accessing, or using Dayly, you agree to these Terms and our Privacy Policy.
Acceptance of Dayly D-Day Countdown terms
By using Dayly, you confirm that you are at least 13 years old (or the minimum age required in your country) and that you agree to these Terms. If you do not agree, please do not use the Service.
Description of the Dayly D-Day Countdown service
Dayly is a personal countdown and anniversary app for iPhone and iPad. It lets you track important dates, create widgets for Home Screen and Lock Screen, attach photos, set reminders, and optionally sync data through iCloud.
We may update, modify, or discontinue features of Dayly at any time. We will make reasonable efforts to avoid disrupting paid features you have already purchased for the duration of your entitlement.
License to use Dayly
We grant you a personal, non-exclusive, non-transferable, revocable license to use Dayly for your own private, non-commercial purposes, subject to these Terms and Apple's App Store terms.
Free and Dayly Pro features
Dayly offers a free tier that lets you create up to 3 active moments. Dayly Pro unlocks additional features, which may include:
- Unlimited moments, archive, and restore
- All 17 themes and 5 photo styles
- Widget Studio with up to 6 configurable widgets
- Lunar and custom repeat rules with advanced reminders
- HD memory card sharing and private backup export/import
- Privacy Lock
Feature availability may change as Dayly evolves. The in-app paywall shows the current Pro offering at the time of purchase.
Dayly Pro subscriptions and lifetime purchase
Dayly Pro is available as an optional auto-renewing annual subscription or a one-time lifetime purchase through Apple's In-App Purchase system.
Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel subscriptions in your App Store account settings. Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.
Your content and data in Dayly
You retain ownership of the moments, photos, and text you create in Dayly. You are responsible for the content you store in the app and for maintaining backups of data you consider important.
Dayly stores your data locally on your device. Optional iCloud sync uses your Apple iCloud account. We do not claim ownership of your personal countdown content.
Acceptable use of Dayly D-Day Countdown
You agree not to:
- Use Dayly for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract source code from the app except where permitted by law
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to store or share content that infringes others' rights or violates applicable law
Privacy and Dayly D-Day Countdown data handling
Your use of Dayly is also governed by our Privacy Policy at dayly.codemxm.com/privacy/. Please review it to understand how Dayly handles your information.
Intellectual property
Dayly, including its design, code, themes, and branding, is owned by us or our licensors and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or brand assets.
Disclaimer of warranties
Dayly is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that countdown calculations for lunar or custom repeat dates will meet every personal or cultural expectation.
You are responsible for verifying important dates and reminders, especially for time-sensitive events.
Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Dayly, including missed reminders, data loss, or device issues outside our reasonable control.
Apple App Store terms
Dayly is distributed through the Apple App Store. In addition to these Terms, your use of the app is subject to Apple's Licensed Application End User License Agreement and App Store terms.
Apple is not responsible for providing maintenance or support for Dayly. Any claims related to the app may be directed to us, not Apple.
Changes to these Dayly terms
We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the effective date. Continued use of Dayly after changes constitutes acceptance of the updated Terms.
